Palin Email Hacker Indicted. Faces 5 Years If Convicted. Pleads "Didn'tDoIt"

KNOXVILLE, Tenn. – The son of a Democratic Tennessee state lawmaker charged with hacking the e-mail account of Republican vice presidential candidate Sarah Palin has pleaded not guilty.

David Kernell (kur-NEHL'), 20, of Knoxville, Tenn., entered the plea in federal court in Knoxville on Wednesday. His father is longtime state Rep. Mike Kernell of Memphis.

David Kernell was released without posting bond, but the court imposed several conditions. Kernell, an economics student at the University of Tennessee, is not allowed to own a computer and can use the Internet only for checking e-mail and doing class work.

Trial is set for Dec. 16. Kernell faces a maximum of five years in prison, a $250,000 fine and a three-year term of supervised release. - Lawmaker's son indicted in Palin e-mail hacking

This follows my small, but controversial, assertion that Palin should give him a pass.

Palin's position will make little difference to the law if it turns out that this man-boy did it. That prosecution will go forward no matter what. Hacking things is, after all, a federal crime. Bragging about it is a stupid crime. Bragging about it so that you actually can get tracked down and caught is a crime so stupid it requires both jail time and a mandatory drool-cup strapped on your chin.
Obviously the Federal Grand Jury did not share my view. Nor should they have.

Shakespeare also said 'Nothing emboldens sin so much as mercy.' If Hacker was certain he would do time if caught, he would not have done it. Ergo, you enabled the crime.
